Debt Recovery for Businesses

Bad debt can damage cash flow and affect growth. Under the Late Payment of Commercial Debts (Interest) Act 1998, businesses can claim compensation in addition to the outstanding amount:

We’ll always advise you on whether pursuing late payment charges and interest is worthwhile, especially where doing so could increase court fees. We also understand that some businesses want to maintain commercial relationships with their clients – we’ll help you balance that with recovering what is owed.

  • Drafting and sending a Letter Before Action
  • Receiving payment and passing it to you, or issuing a claim if unpaid
  • Applying for Judgment in Default if no defence is received
  • Writing to the debtor to demand payment
  • Advising you on next steps if payment is still not received within 21 days

Disputed Debts

If your debtor disputes the claim, we will:

  • Discuss your options and provide updated cost advice.
  • Offer fixed fees (for example, for a single letter) or charge hourly if more extensive work is required.
  • Provide a ‘no win, no fee’ option, charging 25% of the amount recovered to reflect the additional risk and work involved. You only pay if we recover the debt.

Disbursements

While our legal costs are only payable upon recovery, certain disbursements (e.g., court fees, searches) must be paid upfront.

Timescales

Most matters take around 9–12 weeks from the time we receive your instructions to receiving payment – provided the debtor pays promptly after judgment. If enforcement action is required, the process will take longer.
